Preamble

Welcome to the “www.Allegracosmetique.com” website. This document aims to inform you about our company and its General Conditions of Sale.

These General Conditions of Sale (CGV) apply to all orders placed on the website “www.Allegracosmetique.com” (hereinafter referred to as “the Site”).

These General Terms and Conditions are concluded between:

**The Customer**, any natural or legal person wishing to make a purchase via the Site, hereinafter referred to as “the Buyer”.

The parties agree that their relations will be exclusively governed by this contract, to the exclusion of any other conditions available on the Site. In the event of a gap, the practices in force in the distance selling sector in France will apply.

The Customer acknowledges having read all the information and the General Conditions of Sale before placing an order.

 

Article 1: object

These General Conditions of Sale define the contractual conditions between Allegra and the Buyer, whether professional or consumer, for the sale of products via the site www.Allegracosmetique.com.

This contract complies with current French legislation, in particular Law 2004-575 known as the Law for Confidence in the Digital Economy, and with OECD recommendations on electronic commerce.

The acquisition of products via this site implies unreserved acceptance by the Buyer of these conditions of sale, of which he acknowledges having read before placing the order. Before any transaction, the Buyer declares that the purchase of products on the Allegra cosmetic site, www.allegracosmetique.com, is not linked to his professional activity and is intended for strictly personal use. The Buyer also declares that he has the legal capacity to commit to these general conditions of sale.

This contract includes these General Conditions of Sale and the order form. The photographs illustrating the products on the Site are not contractual. In the event of errors or alterations of the photographs, Allegra cannot be held responsible.

 

Duration of application and modifications to the General Conditions of Sale

These General Terms and Conditions are valid from 07/17/2024 and replace all previous versions. Allegra reserves the right to modify these General Terms and Conditions at any time and without notice. The applicable General Terms and Conditions will be those in force on the date of the order.

The Buyer must be at least eighteen (18) years old, be legally capable of entering into a contract, and use this Site in accordance with the General Terms and Conditions.

The resale or distribution of products purchased on www.Allegracosmetique.com is prohibited.

 

Article 2 – Availability of Products

The products and services offered by Allegra are presented in French. Any person from the European Community and countries respecting directive 95/46/EC cannot invoke linguistic ignorance to cancel the contract.

Product offers and prices are valid as long as they are visible on the Site, while stocks last. In the event of unavailability of a product after ordering, the Customer will be informed by email or telephone as soon as possible and will be able to choose a similar product or be reimbursed within thirty (30) days.

Due to the specificity of the Internet, Allegra does not guarantee real-time availability of all products and services. For non-stocked products, offers are valid subject to availability from the supplier. The photos and information on the Site are indicative and not contractual.

 

Article 3 – Geographical area

Products sold online on the Site are delivered worldwide, except in countries where animal testing is mandatory.

 

Article 4 – Order

Any order placed on the Site by “double click” constitutes irrevocable acceptance of these General Terms and Conditions. The “double click” and the authentication procedure constitute an electronic signature, having the value of a handwritten signature. Any validation of a quote by email also constitutes irrevocable acceptance.

The Buyer can place an order online using the catalog and the form. He must check the details of the order and correct any errors before validation. Acceptance of the General Terms and Conditions is required to validate the order. Payment and delivery must be validated.

In the event of a problem (non-payment, incorrect address), the seller may block the order until resolved. The Buyer will be informed by e-mail in the event of unavailability of a product and the order for this product will be canceled and refunded, the remainder of the order remaining firm and final.

Article 5 – Order process

The site www.Allegracosmetique.com allows you to order Allegra products online. The Buyer must complete an identification form and an order form with the references and quantities of the desired products. The Buyer checks the details and the total price of the order before validation. Validation entails acceptance of the T&Cs and recognition of their knowledge.

The online provision of the bank card number and the final validation of the order constitute proof of agreement and constitute payment of the sums due. In the event of fraudulent use of the bank card, the Buyer must send a letter to info@allegracosmetique.com.

 

Article 6 – Confirmation of the order

Any order placed with Allegra must be confirmed to be accepted. Allegra reserves the right to cancel any order in the event of a prior payment dispute. The order confirmation will be sent by email to the Buyer.

 

Article 7 – Price

Prices are valid as long as they are visible on the Site, subject to stock availability. Allegra reserves the right to modify prices at any time and will apply the prices in effect on the date of the order. Prices include VAT but exclude delivery costs, which are indicated in the order confirmation.

For deliveries within the European Union, prices include VAT. For deliveries outside the European Union, the Customer must pay customs duties, VAT or other taxes. Delivery costs are charged extra and are free for orders over 50 euros including tax in mainland France.

 

Article 8 – Payment method

Allegra offers several secure payment methods:

- Bank card (Carte Bleue, Visa, Eurocard/Mastercard) via secure entry using SSL encryption.

- PayPal (subject to PayPal's terms of use).

Payment by credit card is secure and the order will be recorded and validated upon acceptance of payment. Allegra can carry out checks to combat fraud. The data relating to the order are necessary for the analysis and completion of the purchase. In the event of non-payment, the contact details relating to the order will be entered in a payment incident file. In the event of a dispute, the Buyer may exercise his right of access, rectification and opposition.

Allegra reserves the right to refuse any order in the event of an ongoing payment dispute. The Buyer must guarantee that he has the necessary authorizations to use the chosen payment method. In the event of refusal of payment authorization, the seller may suspend order management and delivery.

For orders over 500 euros including tax, the Buyer may be asked to send a copy of their identity document and proof of address for verification.

Article 9 – Reservation of ownership

The products delivered to the Customer remain the property of Allegra until full payment of the main price and accessories linked to the order. Payment is considered made when Allegra has collected the amount. However, the risks linked to the products are transferred to the Customer upon delivery.

The documents provided to the Client are protected by the Intellectual Property Code and remain the property of Allegra. Any reproduction, transfer, or exploitation of these documents without the consent of Allegra is prohibited.

Allegra retains full ownership of the products sold until full payment of the price, including fees and taxes, has been received.

 

Article 10 – Execution of the order

Allegra reserves the right to refuse an order for “legitimate reasons” (as defined by case law), in particular in the event of unavailability of the product, abusive request from the Customer, suspicion of the Customer's incapacity to contract, or of clear intent to harm Allegra. Allegra may also refuse an order in the event of an obvious typographical error leading to an incorrect price displayed at the time of the order. Finally, an order may be refused in the event of a dispute with the Customer, total or partial non-payment of a previous order, or refusal of bank authorization during online payment. The order will be executed no later than thirty (30) days following the order, subject to its acceptance by Allegra.

 

Article 11 – Billing

An invoice will be automatically sent to the Customer when ordering, to the email address indicated by the Customer, unless otherwise indicated by the Customer.

 

Article 12 – Delivery

Products purchased on the site www.Allegracosmetique.com can be delivered worldwide, with exceptions specified in article 3. The following delivery addresses are not accepted: post office box, hotel, cedex, military base. The products are shipped to the delivery address indicated when ordering.

If the recipient is absent during delivery, the carrier will leave a delivery notice and the Customer has fifteen (15) days to collect the package according to the terms indicated on the notice. After this period, the order will be returned to Allegra, who will contact the Customer to define the conditions for possible reshipment, the costs being the responsibility of the Customer. Shipping costs are calculated based on the destination country and the type of service chosen.

Please refer to the delivery section of the website www.Allegracosmetique.com. Delivery times are calculated in working days, corresponding to the processing, preparation and shipping times of the order.

Each order will be accompanied by a summary document including: identification and contact details of the company, delivery costs, payment and delivery terms, essential characteristics of the product, price, address for complaints, information on after-sales service.

Any defect or delivery delay exceeding seven (7) working days must be reported to Customer Service as soon as possible. In the event of a shipping delay, an email will be sent. As long as the product is not shipped, the Customer can cancel the order and will be refunded immediately if the account has been debited. If the product is received after cancellation, it must be returned complete and in original condition to allow reimbursement.

The Customer must check the conformity of the delivered goods at the time of delivery and before signing the delivery note. Any anomaly must be indicated on the delivery note in the form of handwritten reservations accompanied by the Customer's signature. If the delivery person refuses to wait, you must indicate “the delivery person did not want to wait for the item to be unpacked” on the delivery note. Anomalies must also be reported by registered mail to the carrier within three (3) working days of receipt, with a copy to Allegra at the address: Allegra-BP 10627-75829 Paris 17 PPDC, France.

In the event of unavailability of the ordered product, the Customer will be immediately informed and may cancel the order, request an exchange or refund within 15 days at the latest. Any delivery errors must be reported to the seller as soon as possible.

Complaints can be sent by email to info@allegracosmetique.com. An exchange number will be assigned after receipt of the complaint and communicated to the Customer by e-mail. The exchange can only take place after receipt of this number.

Any product to be refunded or exchanged must be returned complete and in its original packaging by Colissimo, with proof of deposit to the address indicated by email.

 

Article 13 – Right of withdrawal

In accordance with articles L121-21 et seq. of the Consumer Code, the Customer has fourteen (14) days to exercise their right of withdrawal without justification or penalties, with the exception of return costs. This period begins from receipt of the ordered products. The products must be returned within thirty (30) days, protected, in their original packaging, in perfect condition for resale, with all accessories, instructions and documentation, accompanied by the sales invoice.

To exercise the right of withdrawal, the Customer must notify his decision to Allegra (Allegra, BP 10627-75829 Paris 17 PPDC, France – info@allegracosmetique.com) before the expiry of the period, by a clear declaration (postal letter or letter electronic). A model withdrawal form is available:

The costs and risks associated with the return are the responsibility of the Customer. The return of the products will result in a refund equal to the purchase price. As soon as the return is processed, the refund amount will be communicated by email and credited to the payment method used for the transaction.

 

Article 14 – Exchange, Reimbursement

In the event of non-compliance with the order, the Customer may return the products received. For the return to be accepted, the Customer must inform Customer Service within fourteen (14) days in the event of a defect or if the correct reference has not been received. Any complaint made after this deadline will not be accepted. Returns will only be accepted for products in perfect condition, in their original packaging. In the event of a defect, the damaged item must be returned, accompanied by the purchase invoice and the return agreement number, to our Customer Service.

The returned product will be refunded or exchanged depending on the Customer's request and available stocks. The refund will take place within fourteen (14) days following receipt of the return. Return costs can be refunded upon receipt.

 

Article 15 – Guarantee

All our products are guaranteed against any manufacturing defect. Defective products must be returned at the Customer's expense for examination. To benefit from the guarantee, you must keep the purchase invoice. Allegra will reimburse shipping costs in the event of proven defects, subject to provision of corresponding supporting documents. The Customer benefits from the legal guarantee for hidden defects, defined in articles 1641 et seq. of the Civil Code.

In the event of a lack of conformity, the seller will replace the non-compliant product with a similar item or the same product within one month of receipt of the damaged item.

The seller informs the buyer of the need to store the products in appropriate conditions: clean, healthy place, at room temperature, without extreme variations. If the products have not been stored correctly or if their expiry date has passed even though they were delivered within a reasonable time before this date, the guarantee may be refused.

Article 17 – Force Majeure

Allegra cannot be held responsible for non-execution of the order in the event of force majeure. By express agreement, the following are also considered as cases of force majeure: unavailability of the product, disruptions, strikes (in particular by carriers), theft or loss by the carrier, natural disasters, war, riots, fire, out of stock, and any other natural disaster, even if the conditions of unpredictability, irresistibility and exteriority are not met. With regard to products purchased for professional needs, Allegra will not be liable for indirect damages resulting herefrom, such as operating loss, loss of profit, damages or costs that may arise.

Any circumstances beyond the control of the parties which prevent the normal execution of their obligations are considered as causes for exemption and suspension of the parties' obligations.

The party invoking these circumstances must notify the other party of their occurrence and disappearance immediately.

All irresistible, unforeseeable, inevitable facts and circumstances beyond the control of the parties, which cannot be prevented despite all reasonably possible efforts, will be considered as force majeure. Blockage of means of transport or supply, earthquakes, fires, storms, floods, lightning, shutdown of communication networks or difficulties specific to communication networks external to customers are considered as case of force majeure or fortuitous events, in addition to those usually retained by the case law of French courts and tribunals.

The parties will consult together to examine the impact of the event and determine how the contract will be executed. If the force majeure lasts for more than three months, the injured party may request termination of these general conditions.

Finally, by providing proof that the non-performance or poor performance of the contract is attributable to the buyer, the seller may also exempt himself from all or part of his liability.

Article 18 – Electronic signature

The “Double Click” associated with the Customer's authentication and non-repudiation procedure when ordering and acceptance of these General Conditions of Sale constitutes an electronic signature. This electronic signature has the same value as a handwritten signature between the parties.

 

Article 19 – Liability

Allegra, as part of the online sales process, is only bound by an obligation of means; it cannot be held liable for damage resulting from the use of the Internet network, such as loss of data, intrusion, viruses, interruption of service, or other unintentional problems.

 

Article 20 – Partial non-validation

If one or more of the clauses of these general conditions of sale are considered invalid by a law, a regulation, a case law or a final decision of a competent court, the other clauses will retain their full force and scope.

 

Article 21 – Non-Waiver

The fact that one of the parties does not take advantage of a breach by the other party of any of the obligations covered by these general conditions cannot be interpreted for the future as a waiver of the obligation. in question.

 

Article 22 – Reservation of ownership

The seller reserves ownership of the products until the price is paid in full.

 

Article 23 – Intellectual property

In accordance with the laws governing Intellectual Property (literary and artistic property rights, industrial property rights), this Site and all elements, brands, designs, models, logos, graphics, etc. located on this Site are the exclusive property of Allegra and its partners, the latter not granting any license or any right other than that of consulting the Site. The reproduction or use of all or part of these elements is only authorized for the exclusive purposes of information for personal and private use, any reproduction and any use of copies made for other purposes being expressly prohibited.

Any other use constitutes counterfeiting and is punishable under Intellectual Property law, without prior written authorization from Allegra. Any simple or hypertext link is strictly prohibited without the express written consent of Allegra.

 

Article 24 – Personal data

The automated processing of information, including the management of email addresses of users of the Site, has been declared to the CNIL registered under number 1356256. It is done in compliance with the provisions of law no. 78 -17 of January 6, 1978. Likewise, any user has the right to verify the accuracy of this data, and may request its rectification or deletion by writing to Allegra at the following address: Allegra, BP 10627 -75829 Paris 17 PPDC, France.

Information and contact details concerning the Client are confidential. They are used to process orders and to send information on products similar to those previously provided.

The Customer has the possibility of objecting free of charge, apart from those linked to the transmission of the refusal, and in a simple manner, to the use of his contact details, each time a message is sent to him. Article 25 – Entire contract

These General Conditions of Sale express the entirety of the obligations of the parties. No general or specific conditions communicated by the Customer may be incorporated into these General Conditions of Sale.

 

Article 26 – Evidence

The computerized records, kept on the servers of the Allegra company as well as on the servers of its banking establishments, will be considered as proof of communications, orders and payments made between the parties.

 

Article 27 – Conservation and archiving of documents

The archiving of transaction data is carried out on a reliable and durable medium, in accordance with article 1348 of the French Civil Code. It is therefore carried out in compliance with the AFNOR Z 42-013 standard relating to the design and operation of computer systems with a view to ensuring the conservation and integrity of the records stored in these systems.

 

Article 28 – Applicable law, Disputes

These General Conditions of Online Sale are subject to French law, in accordance with European directives, notwithstanding any rules relating to conflicts of law. In the event of a dispute, the parties will favor amicable settlement.

Any dispute relating to the interpretation or execution of this contract between Allegra and a natural or legal person considered as a consumer will be brought before the French Courts, in accordance with the provisions of articles 46 to 48 of the NCPC.

For any Business to Business type contractual relationship between Allegra and a legal entity, the attribution of competent jurisdiction is entrusted to the courts of Paris.

 

Article 29 – Anti-waste law

On February 10, 2020, the Anti-waste law for a circular economy (AGEC) added to article L. 541-10-13 of the Environmental Code an obligation to register producers with the public authority ( ADEME), which assigns them a unique identifier. The producer can prove that he has fulfilled his EPR obligations by using this Unique Identifier (UID). The ADEME UDI for Allegra is FR381898_01SOPS.

 

Appendix Glossary

In this contract, each of the expressions mentioned below will be understood in the sense of its definition, namely:

- “society”: Allegra

- “online sales contract”: any contract concerning the ordering of products concluded between the company and a Customer as part of a distance selling system organized by the company Allegra, which for this contract uses exclusively the Internet network until the conclusion of the contract, including the conclusion of the contract itself.

- “Customer” or “Buyer”: any natural person who, in this contract, acts in a private capacity or as a representative of a legal entity.

- “order form”: document which indicates the characteristics of the products ordered by the consumer and which must be signed by him by “double click” to commit him.

- “order”: act by which the Customer undertakes to purchase products and the company to deliver them.

- “product”: good sold by the company.

- “double click”: reiteration of the validation of the order form by the Customer. A purchase order completed and validated for the first time is never taken into account without confirmation from the Customer. This confirmation can be made by means of a check box indicating acceptance of the General Conditions of Sale, or by an order confirmation message.
